Fair or not, it’s fiverr who decides. Unfortunately there is no law over this to decide if it’s fair. Who violates ToS may risk to get their account disabled.

As stated in Fiverr’s Terms of Service:

"Fiverr reserves the right to put any account on hold or permanently disable accounts due to breach of these Terms of Service or due to any illegal or inappropriate use of the Site or services.

Sellers will be able to withdraw their revenues from disabled accounts after a safety period of 90 days following full verification of ownership of the account in question, from the day of the last cleared payment received in their account and subject to Fiverr’s approval."

When he created his Fiverr account, he agreed to be bound by these terms, just like everyone else using Fiverr.

Can he use a permanently disabled account? No, it’s permanently disabled.

However, he can ask Customer Support for permission to create a new account.
