How you define broadcast rights is up to you.
There are conditional statements in the terms which allow talent to pick and choose how commercial / broadcast rights are applied, as long as the gig page / FAQ section etc disclaim everything so the buyer is on the same page: it works how you want it to.
They’re in it for the cash though so all I will say is proper rights need proper rates.
