Please Help I Dont Understand!

Hi, I’m a musician selling music on Fiverr.

What I don’t understand is if I choose not to grant commercial usage in my gigs, what does that allow the buyer to do with the music? I want to retain my copyright so I still own and can sell/use the music elsewhere but I also want my music to be used the videos and films of buyers.

If I don’t give commercial rights can they still use my music in their films or not?? What usage have I agreed?

Please help!
Thank you

Am I just granting usage/licence in this case? How do I know they wont sell the music on/use it somewhere else?

From the ToS:
Buyers are granted all rights for the delivered work, unless otherwise specified by the seller on their Gig page. Note: some Gigs charge additional payments (through Gig Extras) for Commercial Use License. See our “Ownership” and “Commercial Use License” sections below for more information.

Sounds like those sections would be worth a read?

@jaredp219 Hiii… I think If you provide commercial usage to your buyers in Gig, It’s surely gonna increase your sales and success rate on Fiverr.

Surely someome here gonna make it more clear to you.

Good luck to you !

Yes I understand that (and it’s what I have been doing previously). I just would like to know if I don’t grant the commercial rights can the music still be used in their project whilst I retain the rights as an artist instead of selling them? If they only want the music for their video/film that should be ok right?

Not a specialist in international law I’m afraid. Perhaps you need to find some legal help to work out the wording of your gigs as to what is/isn’t offered, and to work out what to do if a buyer does something with their purchase which you don’t want them to be able to do?

Ok thank you. Just for clarity then… If I sell music without commercial rights, this doesn’t allow them to use it in any film or business video?

I’m sorry - I don’t deal with music in the same way you do, so I really can’t say yes or no. :slightly_smiling_face:

Find a lawyer! :sunny:

From @annai80 who knows far more about these matters than i possibly could:
