UK sellers - what are you doing about insurance? I’ve been updating my PLI and PII to include Fiverr and the insurer has asked what jurisdiction the Fiverr contract falls under?
I have no idea - but I just want to say thank you for asking an interesting and intelligent question. I was losing hope. Hope you get the information you need.
Suggest you refer to the Terms of Service at the bottom of the Fiverr main page.
There is a section on Limitation on Liability.
Maybe I’ve misunderstood it but the limitation on liabilities section seems to refer to Fiverr itself rather than sellers?
Additionally they say:
Sellers are responsible for obtaining a general liability insurance policy with coverage amounts that are sufficient to cover all risks associated with the performance of their services.
This is the response I had from Fiverr so I’m still none the wider!
Fiverr’s Terms of Service cover the legal terms applicable to users of Fiverr. However, we are not able to provide our users with legal advice with respect to the Terms.
We would recommend consulting with an expert on the subject, so they can guide you accurately.
